    Thanks again guys! I have filed on IC3.gov complaint against Hudson Valley Host and ColoCrossing.

    BBB is the next one up. If I never get my $260 back, at least people can see how I've have been treated by Hudson Valley Host & ColoCrossing and NOT make the same mistake.

    But I will certainly not become a "beggar" or fall for their bribe of giving me 2 months free. Even if they offered me a "free for lifetime" I will still say no to that. Screw that.

    Introducing selective reading

    Ernie HVH selling cheap dedicated servers without capability to refund money- mike is the guy who are payed from HVH and capable to refund money for not delivered server and services in timely manner

    Both Ernie HudsonValleyHost cheap dedicated server reseller and Mike guy with capabillity for refund just escalated not dellivery to lost of confidence with client just ignoring client request for refund.
    In meantime shxxxvaluehxx guy doing lxp-dance to make more time until CC deliver second server, finally jbiloh scratch more time talking with HVH client trying to cover not delivery with free mnths of service.

    False advertising, violating TOS and not dellivery at all hardware, for what reason CC dellivered hardware partially and get also money without any binding to HVH client, also if Mike not belong to HVH that also violated TOS and privacy.

    Dedicated Servers are not instantly activated as they have to be built. Typically, all servers are released to you within 48 hours (usually faster). Server builds occur 7 days a week.

    Hudson Valley Host does not offer any refunds on web hosting including shared and reseller accounts,
    dedicated servers, VPS, web design, and domain registration.
    You may cancel your dedicated server at any time however no refunds will be issued. Licenses and add-ons are non-refundable.

    Wow this is becoming more interesting. Someone wants to do interview with me regarding this situation and feature it on their website. I just saw the message so I don't know who that person is yet and etc. Or if this is a trap? Let me think more about it and will keep you updated.

    This is false.

    Signing a contract to work with someone as their attorney when you aren't one can get you sued/prosecuted.

    Giving an opinion in a public forum is not going to get you sued because the recipient has no reasonable expectation that (a) you are an attorney, and (b) they have hired you.

    The phrase "IANAL" is a discussion disclaimer (like saying "I'm not an expert, but..."). It has nothing to do with being sued.

    If you disagree, name the "states" and provide examples. Your LegalZoom example doesn't apply because they were taking money from customers and providing a contracted service - world of difference between that and spouting off in a forum.

  • This has been going on for awhile now. I hope the OP gets the refund swiftly. I think this is going too far as a whole. It is sad to see that the OP has to take such swift actions.

    Update, I received this message from Ernie today. Quite shocked as he has been ignoring me for days. Baffled he is only offering me refund on 2nd server as he delayed delivery on both servers. Amazed he is expecting me to stay with him even after putting me through all this....

    @Monster - of course, that is why I just completed BBB complaint. There's no apology, no remorse from their side. It would've been nice if Ernie started with "Hey, I am sorry...." but who am I kidding?

    There's no way I will only accept 1/2 of refund. No way. I have been getting PMs on another forum advising me to file complaints with the New York Attorney General, Visa company, and IRS. In the beginning I was completely lost but thanks to you guys, I might actually get my money back. I don't know yet though.

    I have already filed a few of them so if that's what I gotta do to get my money back then that's what I will do. Let's see how this plays out.

    $260?? HCH/CC must be really desperate for money if they fail to realize why they should give back your money.

    As ColoCrossing pocketed my money directly, I think the title could be misleading. I would like to have CC & HVH both in my title. Thanks!

    I think that you cannot change the title/post after 1 day.

    If you need it changed you can always try to PM one of the moderators.

    If that is true then changing the title/post yourself at this place would be pointless aswel

    they could just get rid of this thread at any time no matter if its right or wrong.

    Only Alex and I work for ColoCrossing @hardcloud.

    As an update Hvh has offered the customer a refund for the server which was delivered late. The customer can choose the refund, multiple months of free service from ColoCrossing, free service at Hvh or continuing the campaign of spreading a story which does not properly reflect just how much attention they have received. Either way I wish the gentleman well and trust he can communicate his desired conclusion through his ticket.

    I consider the matter now resolved and will not direct any further attention to it.

    I am NOT okay with you painting the "bad guy" picture over my head numerous times on this forum just to save your face. You guys delivered BOTH servers LATE. So once you offer me REFUND for BOTH SERVERS, then the case will be resolved.

    1st server was delivered 2 weeks after I paid - this is considered as LATE DELIVERY.

    2d server was delivered 3 weeks after I paid - this is considered as LATE DELIVERY which you guys have admitted to.

    So either admit to all wrong doings or don't admit at all. You can't pick & choose here.

    I, the customer, who paid to ColoCrossing (without my consent as I paid to HVH using their portal) will determine if the case has been resolved or not. Not you. Please get that straight through your head.


    I see that @jbiloh has closed down this thread without my consent and without resolving this issue. I want you guys to know that I will NOT give up this fight of getting my money back 100%. Please support me on the other place.

    I am shocked that admin would abuse his power in this manner but what more can I say? If there's any way I can keep this thread re-open please let me know. Thanks!

    Thank you for your additional post and sharing your opinion. Now that the issue is fully vetted and a refund on the Second server has been offered this issue has run its course.

    It seems a refund was only offered on the second server and not the first server. So I don't believe this issue is resolved either. It seems that @jbiloh missed out that the OP will not stop until a refund on both servers has been received.

    Jon closed down this thread for few minutes after posting this message to me. But then it became re-open again.

    Either way, glad it's back open. Resolution has not been met and I am truly tired of all this bullying by Jon and his team.

    Hey Tim, I understand that you are new to the ColoCrossing team and how you are on their side. I get it. However, I see your NodePacket LLC is only 1-2 months old and you are looking to make some $$$ in this hosting business. I think it would be your best interest to stay out of this conversation as more you side with ColoCrossing, you are portraying to your future customers that delivering servers 3 weeks late, calling the customer foul names, and swapping customer's name, address, credit card information, etc with 3rd parties are your policy.

    Also - what you have told me in the IRC chat room just moments ago really made me uncomfortable. You knew too much about this situation, things I have not even mentioned on here. So before I reveal your true colors, please stay away. Thank you.

    Seems pretty clear. They obviously can't afford it. Anyone else in their right mind would have done it at this point.

    No refund is available on the first server order because there is no justification for it.
