There is quality parameters of service. If those are not met - service deemed to be unusable and contract can be disputed on that basis.
i understand but also on other side they do provide internet as was paid, its his bad luck to getting attacked, is in contract anti-ddos ?? again its usable, but he got really bad luck

This is what I say. If I migrate to OVH whole infra, I'll pay 2150Mbps in Romania without any gain.
They do, ~600-1000 USD.
He is a client at Orange for ~2 years. I think he cam contact them, explain that he is getting fucked, ask for a DDOS protection for 1 mo, even if payed more, and just get on with it.
If they say no, I would just stop the use of their services, get a layer and solve the issue in court, in Romania, that is like a 2-3 year process.
If you loose your customers, you will be in the situation of not being able to pay the bills and still get sued by Orange + RDS + all the others because of debt you will have.
See the problem here? If you do nothing, you will end up in the same place.

Do you, as a consumer of Orange, deem this traffic usable and service provided to you - OK? No. Than it is a ground for dispute with provider. If you lack knowledge about B2B relationships, maybe you can hire temp person who can help you to discuss issues with provider. Because now it seems you are simple person and Orange is big corp.
Apply B2B communication here. And B2B communication is pretty straightforward: give me what I can sell to end user or I will find better deal elsewhere.

Orange is not dumb transit. They are customer facing business. If their customer (take a note - also a business entity) can't provide service for his client - what's the point from such relationship?
I tried to push the pedal with this since Friday at the 1 -> 2Gbps deployment.
I told them clearly, help me with traffic filtering ( the technician who only analyzes the solutions said that it is possible for them to block the ASN through which the attacks come for free) because otherwise I will go bankrupt and you did the deployment for nothing (the costs of installation were 0 always).
They simply don't care.
Tell that fucker, that in 2 days he as might send the invoices to he's mama to pay them, as you will be out of business. Trust me, he will understand.

Florin, you lack aggression towards solving problems. Successful business owners are a bit insane, sociopathic and pretty aggressive persons. Stop emails, stop phone calls. Drive to their headquarters, demand C class sales person visit and lay down what is wrong and that you are here to terminate contract. I believe Romania is no different from any other country in Europe. If you communicate with wrong person - you get wrong answers and actions.
If John is NOC person and he does not do what you ask him to do - go to Bob, who is in charge of John. If Bob says "go fck your sister", go higher... The chain of command exists everywhere. Start pissing off right persons to get results.
100% this, who takes "no" or "30 days" as an answer when their business is on the line. Nothing takes 30 days in this scenario, they're mugging you off and you're mugging yourself off by just rolling over.

What will happen on cancel? Will fat guys drive by and brake legs or peper your windows with large calibre guns? Does contract bind you to give your soul in case cancellation?
Such contracts would be one-time than. No sane business would pro-long them.
