    VPN is not allowed at OVH anymore.

    This is just pure b/s. VPN is allowed, the latest AUP just says that if they find someone doing illegal things involving a VPN (or IRC or Tor), they reserve the right to terminate the server.
    @xset, you post in this thread more than perhaps anyone else here combined, it's all good when you relay useful stuff from OVH and Oles, but not so cool anymore when you just spread misinformation.
    I wanted to correct that, and it's already buried two pages down, where a number of people already jump to conclusions like

    Seems like OVH "dedicated server" has more restrictions than a LEB "VPS"...

    And about this:

    ...it's not the actual AUP anymore, it's got two more updates, basically removing all the "kinds of use" restrictions.

    And yeah, VAC can be turned on/off at will, I tested it out yesterday, the traceroute looks pretty nifty

    I am not sure that is OK. So if i do something illegal involving anything else they do not terminate my server ?
    No, the thing should read: If you are doing something illegal, then we reserve the right to terminate your server. Simple and very clear.
    Mentioning VPN means that there is something fishy about it or IRC, or Tor and they expect people using them to benefit from more scrutiny. The thing about surveillance is that it becomes it's own reason to be, put under the microscope, everything looks suspicious.

    Yes, I find that clause to be ridiculous for the same reason. Google translate:

    7.4 For security reasons, OVH reserves the right to proceed with the immediate suspension without notice of any server on which would be offered free of charge or for a fee, a public Proxy, IRC, VPN service, TOR for which OVH has knowledge of misuse, fraudulent or unlawful.

    Actually you could read this as concerning only
    public Proxy,
    public IRC,
    public VPN
    ...which is supported by them mentioning "free of charge or for a fee"; which makes no sense if they meant personal instances of these services.

    Quote me the exact line of the terms where it is disallowed. I quoted above the only mentioning of it in the current TOS, which also implies legal use of IRC and VPN is allowed.

    Actually none are disallowed, you can do anything if it's not causing problems, however if you do run a public proxy, and they find out it has been used for illegal stuff, they have the right to terminate your service.
    Also I think they were referring to a public VPN service, public IRC service, and a TOR exit node, but I think it should be "of any server that would offer(provide?) for free or for a fee". (I think his mother wrote the terms). I think the private ones are included also, so if you use them yourself for illegal stuff, they will also close you down.

    This is the "clarification" for this:

    There is nothing to that effect in the contract I've agreed with the OVH – but perhaps there are different versions.

    In my agreement §7.5 simply mandates that all proxies (and like services) must require signing in – not that they aren't allowed.

    BTW they said at some point everyone will be required to accept the 2013 TOS when they renew their server (or not be able to renew), so soon there will be no more differing versions depending on when you bought the server, everyone will be on the version of this year.

    My version is dated 3/13, so it is actually from this year – but obviously it isn't the new French contract, and I'm rather sure it won' be exactly the same even in the future.

    I've signed an agreement with a local subsidiary (separate legal entity) and thus my contract has to adhere to the local laws and to some extent, to the local business practices.
