That's on the provider as it's his responsibility for the TOS to be accessible. Since the TOS is not accessible it is not binding. This doesn't mean there is no contract, there is because the law provides a default one and that's the only thing that is binding in this case.
Every EU business is required by law to have certain information provided on the website and that information needs to be accessible as well. There might be slight differences from country to country as to what is required to be there but in essence contact information, company info, address and so on. If this is missing and someone reports it you get a hefty fine.
Not necessarily. Almost 90% of our ToS is practically a copy of the local laws. We just know no one will read in Hungarian language. No privacy policy is a bigger issue than no ToS.
ToS in EU in many countries is regulated by the Civil law and Contract law. Which are mostly quite reasonable.
As laws change daily in EU we put in ToS the requirement to adhere to Hungarian laws - which includes International agreements signed by Hungary, EU laws and Hungarian laws like Civil code, Contract laws, Criminal code, particularly including the Cybercrime law.
Generally speaking almost all of our services are well regulated and outlined and I'm sure any country without common law follows similar structures, especially Germany.
But honestly if you sue by saying you didn't know the ToS it's not an excuse, because you signed the mark that you read and accepted the ToS and that'll be the end of story because why did you mark it if you didn't actually do it?
It doesn't require ToS to be provided though. Provider may claim to that contract is sent UPON REQUEST. Of course it is obviously a problem because the ToS on site is not opening even for me. But it's not an excuse that you don't have ToS on the website. Many shops and services don't have it on the website.
