    You can go to the police and 'sue' everyone if you have a case, no matter where he is. This laws were mainly enacted to have criminal cases against foreign citizens/companies that commit crimes in Austria or against Austrians (internet scams and so on).

    The case is sent to the FBI for investigation, this takes 3-6 months (what Austrian police told me) - The defendant is then ordered to appear in Austria or the case is moved to the US jurisdiction applicable. Failure to comply (if found guilty in court) can result in a trading ban with Austria (and Austrian citizens abroad) and on request all EU members plus Switzerland, Liechtenstein, Norway and Iceland (EFTA). Failure to comply with that causes criminal lawsuits by the governments that enacted the ban (as well as fines up to 250000EUR per customer served in the area). I don't need to care much how it works or how long it takes as it is a criminal case (defamation of a company is a "felony" here) and thus all costs are (for now) covered by the Austrian government, as with any normal police investigation.

Not really, i just walked up 2 streets to the criminal police (LKA/BKA building), asked the guy on the entrance for the right department (hohoho, i know that building well enough by now anyway...), gave the officer my print out of the FraudRecord entry, my eMails with them and the GVH support responses, he wrote it down, told me i should also report at the FBI with his contact data and the Austrian case number and left again. From there on the investigation is a Police job.

    Ah, nevermind then. Sounds more like the police have to bust their butts on the case more than you do. All of your part seems to be just reporting the case and presenting your side of the story.

  • I don't think its a waste of police resources. Its not like Pwner is the only one that had issues with GVH.

    He was the only one that actually made something about it, I am sure everyone else that dealt with GVH would thank him for this.

    I get the feeling William will pursue it for all it's worth, and good on him. If GVH disappeared it'd be doing LET and customers a favour.

    If the police see enough merit in that pithy screenshot...

    Surely, if all these issues exist ARIN or there provider(S)? will get involved, it wass like 123 reg did when they lost ICANN

    For me, and for Austrian law, this is CLEARLY defamation. Austrian Police confirmed this and the Staatsanwaltschaft (Public attorney) sees enough for a criminal case. The FR entry is a LIE and PUBLIC and caused declination of orders from other ISPs (= damage caused). That is all required.

    I will push this as far as i can with my (currently) limited ressources (read: money) - I write it in public as well, outside of IRC: It is war now. You can quote me on that.

    Ho hum. Of course the IP / ARIN proof is harder to actually get done. But too easy to bully a kid from New Hampshire who's just a younger Earnie from HudsonValleyCrossing.

    Otherwise you sound a bit nutter going after a fraud record hit for email. Hint - use new email. The IP fraud however, is big deal, no one gets anything done.

    I am already in contact with ARIN due to the allocations. Of course this depends on ARIN - I have no influence on them. And people that know me KNOW this is not the first time i did this, i have a record of having MULTIPLE allocations revoked by RIPE already (largest a /15 of a LIR in Germany) - I was PERSONALLY at the RIPE office in Amsterdam to speak to them, and if the same is required for ARIN i will find a way to make it possible, no matter if i have to pump money from someone else or take more debt.

    I don't even decline that i am 'crazy'. I play hard and fast and lost sometimes - I hope this is not one of this cases but time will tell. I will NOT use a new email - I ALWAYS used william\@//william\;.\si and i won't let me stop from some lied FraudRecord entry, every ISP that declines me due to that is new food for the case by the damage caused.

    @drserver The FR report has been gone for days now. I don't know who put it up, but since I couldn't confirm or deny it's accuracy, I took it down.
