    Yes, but you'd just be the ISP in that case, probably win in court (though of course not worth the risk for measily profit one would be making).

    I'd be concerned that it could be difficult to prove that one was the ISP and not using the IP personally. Or am I totally out to lunch with that concept?

    Manquehuenet are from GTD Internet , and they are "residential"

    Well, as these are issues of criminal liability, I would think proof must be provided by the state that the criminal activity was due to your use of the IP.

    Thus I think if you can prove that you did have customers renting out your IP, that ought to be enough; you wouldn't have to prove that the offending traffic was due to a customer.

    There are other forensic methods that the state can use to establish whether it was your conduct or not, and I think it would be expected to apply these in such a case.
