To @DeluxHost's credit, after a quick PM and then checking my tickets, they've apologized for the mistakes, and in a matter of like 30 minutes handled another ticket that they had to escalate to aurologic. It has now been fixed.
Not really.... I have flexibility to use upto 1 CPU when I need it in extreme times. But if that entire 1 CPU is not available for me, then even for minor processes my server is gonna gasp & create load..... Plus I am not the only one who has raised this issue... Many people have raised exact same issue with supporting screenshots. BTW which series are you using ?

I think that thingy is perfectly fine for adequate usage like e.g. a normal NS server or a not "slashdotted" static website or a mail server dealing with modest load (a couple of hundred mails per day).
As for DeluxHost suspending "abusers", I'm a bit sorry for those concerned but not only accept DH's attitude but actually welcome it, because I don't like reasonable users to suffer from what those who expect more from that super-cheap thingy than what they pay for.
Finally: come on guys, it's not like there was a lack of seriously cheap VPS offer on LET. Maybe try one in the €/$ 18 range per year if you need a bit more oomph than this thingy here can offer but still want to stay in the <= €/$ 20 per year range.
my processes don't generate 18 load average... That's still quite high, even if the node is under load.

Not sure what you are talking about. I know there's a threshold for small theft and such where prosecutors might not pursue the case on their own initiative when reported by the police. But you can sue privately for any amount no matter how small.
Heck, you can sue someone for the wrong color, shape or size of a button on their website and you will win the case. Even if you are not a customer, for example if you are a competitor you just sue for unfair commercial practices.
The other side will pay this cost when you win the case.
To be fair I did say in my first post in this thread that it's a 12 per year vps and some common sense should be applied when purchasing. That being said, did DeluxHost say anything like "It's a dirt cheap promo vps and you can expect lower performance than from standard offers" or similar when he posted the offer? He didn't so he shouldn't expect that "common sense" from all his customers.
And in case you loose you ll pay the other side's cost as well as yours. You might feel confident to win, but there always is the risk that you don't ... and then we're talking about thousands of €€ or $$. Who is willing to take on that risk over €/$12 per year?

As for "common sense", sorry but IMO common sense strongly suggests that a super-cheap VPS does come with limited performance (and it also suggests to actually read the TOS/AUP).

They can always make the "truth" smell nice but really, seriously there's again "this and that eu law" that requires there to be appropriate disclosure even if something is free/promo/deal, etc.
Let's see what's common sense IMO; For a promo/deal most people will expect to get the same product as the regular one just with reduced pricing and not a crippled one. Or same pricing with more resources, whatever, you get the point. I don't know where you come from, but where I come from when I make a promo I make no difference whatsoever from the regular product and both get the same level of service.
But in the VPS market it's more like this: two girls want their tits enhanced and they notice this promo with half price, must be a great deal. And when it's done and they complain the surgeon says "what did you expect it's super cheap deal and you get just one boob done each".

I kinda agree with him, but I think it's just different approach to promotional package.
I tend to agree, BUT: AFAIK @DeluxHost so far only did promos, so there is no regular product to compare against.
But still, I for one am happy with what I get for a ridiculous amount of money and would consider to buy another VPS from them if they had other attractive locations than just NL, AMS. But then, of course I know what to reasonably expect and what to use it for.
As for your comparison, sorry but it doesn't fit, because you actually get what you buy and pay for (as opposed to "sorry, only one boob for that low price"), a better comparison would be that say, both are less well done than expected (and then still, there's quite a difference between boobs and a VPS, and I mean in terms of importance *g).

Not delivering just because your cheap is no excuse. Unless you're virmache. Granted, they make it no secret that you might experience subpar performance.
I have plenty of 3-15/y servers. When buying on the cheap, you gotta check who you're doing business with. Delux being new... Wouldn't get my hopes up. It's a gamble.
Sometimes it works out fine and a host last for years doing absolutely fine. You Sometimes get real gems.... sometimes you don't. So you suck it up and cancel that $3/y server.
I'm on the fence about Delux. I know I cancelled on them a while ago, just better and more time proven options around. Server never performed well, location change within the year... Still not performing that well... not worth it for me. But I won't be bitchin about it. The moment I ordered I knew I was gambling.
