    Seeing how he accessed the server and changed the contents, he's technically committed unlawful access to computer and broke the law, not just a commercial policy. This wouldn't fall under administrative usage because he changed the root password.

  • Don't forget about EU law which may or may not have made it into Dutch law, depending on the instrument used (Directive v Regulation).
