I don't think he can collect an amount as VAT in the invoice and not pay that to the tax authorities. AFAIK that's the law in most countries.
So it's probably not a case of maximising profits it's just unnecessary over reach.
There is no VAT on invoice for outside EU b2c. Just sign up.

Our prices are fixed and include 17%,19%, 21% no matter of your EU residence or no VAT at all.
The price is fixed 48€ for everyone.
If a business is offering fixed prices that include VAT for EU customers and exclude VAT for customers outside the EU.
Therefore, our pricing structure includes VAT for EU customers and excludes VAT for customers outside the EU. This is in compliance with applicable laws and regulations.
I strongly recommend you double check this with your lawyers and accountants.
As an EU national, a trader cannot charge you more when you buy a product or service just because of your nationality or country of residence. Some price differences can be justified if they're based on objective criteria and not just on nationality. For example, differing postage costs may mean you pay more for delivery in one country than in another. However, traders may still set different net sale prices in different points of sale, such as shops and websites, or may target specific offers only to a specific territory within a Member State. Under EU rules, all these offers must be accessible for consumers from other EU countries.
However, there is no possible justification for differences in access to goods or services for customers from different EU countries in the following three situations:
sale of goods without physical delivery – for example, if you buy something online that you will collect from a shop, rather than have it delivered to your home
sale of electronically supplied services (excluding copyright protected content) – such as cloud computing services, or website hosting
sale of services provided in a specific location – for example hotel bookings, car hire, tickets for entry to theme parks
We will check this for sure. I dont think anyone is discriminated. Everyone has same price 48€. Fixed price scheme.
For now it stays as it is.
Any complaints your lawyers find our legal contact on the imprint of our Website.

If you argue the price including VAT is the same everywhere, you're admitting that you're discriminating against businesses in low-rate VAT countries, and so breaking the law.
And I believe, although I've not looked into it in depth, that the rules require the non-VAT price to be the same everywhere and for customers to pay the appropriate VAT rate for their country based on that price.

I suspect nobody will bother getting lawyers involved, as the cost of doing so would be far in excess of the difference in VAT payable.
However, if people your company is treating them unfairly due to their nationality, they will probably just choose to use a different provider instead with less scummy pricing tactics.
