    It's not just a "brand" it's a trademark (see: https://www.cpanel.net/trademark/ ) and a trademark must be legally defended or it will be lost.

  • @donli thanks for that. I mentioned that it was trademarked in an earlier post. This post was in relation to the length companies will go to protect their ‘brand’ and yes it is a brand in a marketing context.

    If i was you, i'd use the furthest *out of reach providers and pay for the services on the longest term possible and run into the woods bare ass naked, scaring the wildlife...

    But, nobody is out of reach.

    Anyhow, i don't think you are right using their brand for your services.
    It's a sort of mooching off and possibly staining the name.

    You already screwed yourself by admitting guilt, by typing that disclaimer on the site... And archive.org probably remembers it all too well.
    The more you run away, the more they chase you...

    Maybe rebranding is a possibility, but don't give them your domain name. They can't have it all. And if they have it, it's going to be bitter, no matter who is right or wrong, this is how things are.

    Anyhow, stop screwing around and get a real lawyer, the side with the most money - wins.

    If i were you i would consider talking a lawyer because big companies like cpanel they have a legal department so i think they would do anything to stop you

    Realistically, anyone hoping to grow his business by trademark infringement doesn't go far enough to get noticed.

    If you get big enough though, you get sued. I do think OP is lying here, hoping to get some attention and traffic.

    Yes thats why there are copyright laws. For plagarists like you. The site is a blatant ripoff off cPanel's brand especially so when you dont even use their products and l damn well hope they sue your ass.

    Others may not agree with me but I see a completely intentional effort to gain returns off someone else's effort and that makes me angry. Doesn't matter who you are or how big your company is. Period. Its their kindness that the website even exists.

    Are you looking to get absolutely destroyed? If it was just the name you might get away with it as mentioned by joepie91, but you've also been using their logo and building your brand on their reputation.

    Now - in a bad faith attempt to legitimise your claim - you've registered a company using the name after becoming aware of your infringment. Btw, congratulations, you just made yourself a presence somewhere where the trademark is definitely registered - https://trademarks.ipo.gov.uk/ipo-tmcase/page/Results/4/EU004908299 - if you were previously entirely outwith the jurisdiction of their trademarks, you aren't anymore.

    As someone who has been involved in a trademark dispute before, I really don't think you have a leg to stand on and I think you are digging yourself into a hole. If you agreed to cease infringement and rebrand earlier, it would most likely be case closed on cpanels end. Dealing in bad faith might make them come at you for damages.

    Looks like you really rely on this project paying your bills. I would suggest to take some money and consult a lawyer specialised in trademark but just have a look at cPanels Trademark Policy. Let me quote the relevant part which pretty much damns your entire business and CPanel will most likely take you to court.

    The cPanel trademarks must be used separately from other logos, trademarks or service trademarks, and may not be used as part of the name for any other organization or its products or services. No one, not even a licensed partner of cPanel, may use a name for itself, its products or services that incorporates, or is confusingly similar to, any cPanel mark.

    Tell us what you plan to tell a judge how you don't violate their trademark to make money?

    That was a very bad move mate, like very very bad move. You're a tiny fish compared to cPanel. It would be way better to transfer your entire company to another domain not related to cPanel and continue to offer the service rather than registering your business.

    You just said to cPanel, 'f##k me x2 now'.

    The main problem is that your company must have a UK presence and you need to register your company for tax as a non-UK resident.

    All I see is a cheap scammer who tries to make some money by f_cking all parties. By having some much searched for key words all over the place and even in the domain name, partially obviously illegally, he tries to generate adsense income and to become a someone in SEO to create more income.

    I hope that cpanel shuts his scamming operation down and ifastnet.com, his provider, should also think about shutting him down.

  • Change the name. Forget the money you put in registering this company. They offer you some time while you move your site: use it!

    Change name ASAP (why didn't you do that a week ago?) and 301 all pages, panels and cie. If you do that you might even be able to keep your original domain (with no content, just 301s) for a while if you are not willing to give it to them, or you can ask them to keep the 301s.
