How does a meme get you a severe warning?
Yet there are users who post in bad faith, constantly flame and they get away with it.

Somebody please explain the standards here lol.

oles liked hetzner, i think he got a special deal or something for his free vps project, and so he wanted to be their knight in shining armor and used his moderation power to warn me for posting a meme about hetzner

Can you post that meme again, now that he is no longer in a position to warn anyone?

i have a faint feeling it was this one

Given that he just reported this post and the linked post that I wrote earlier, I assume that the user doesn't want me to answer questions about it.

This is hilarious given he was the one who blocked me on Reddit, preventing me from replying to his post in my reddit thread.

I can't even access his subreddit (I'm banned there, no surprise) except in an incognito window. I literally don't have a report button, so now he's just flat out lying. (I never reported either of his posts)

Some crazy stuff going on in the reddit thread - I went in earlier and upvoted a few of the buried threads on there, and a few hours later my reddit account got flagged for "suspicious behavior" (!), the top post also is talking about how there's been crazy brigading and flagging on Reddit's end. I've used reddit for years and never once got a flag on my account like this, it's got to be related

Aaand here is there real deal:

"Here's the short version: this person has been stalking and harassing me across platforms, and filing fraudulent legal complaints against our vendors in an explicit effort to get MXroute shut down. After one of those complaints caused real disruption, I contacted their employer, not to get them fired, but hoping they'd de-escalate once they realized I knew who they were and could pursue actual legal action if necessary. That got reframed as "tried to get me fired.""

Reporting someone to their host for breach of ToS is harassment?

Things calmed down a bit. A large Reddit thread was created. It got botted in the pro-jar direction for a while but the bot votes were removed and it's settled where it is now, which is people criticizing jar for his actions.

Jar claims that those fillings was fraudulent and caused business disruption. So, who started the shit show first? OP or Jar?

Fraud requires an intent to deceive. WyvernCo obviously believed (wrongly) that his trademark theory held legal water. If he had just gone with ToS breach in the first place, it would have been valid.

Reporting someone for a ToS breach is not fraud. The person who started the shit show first was whoever took criticism personally and replied with personal attacks. WyvernCo was not 100% innocent either, but his biggest crime isn't retaliatory reviews or doxing or abusing influence to spread insults, but misunderstanding how personality rights laws work.

@Levi Already addressed in this thread, but:

    • when Jar started the attack sale and ignored my request to stop it, I went on to request his providers shut it down. He was making money off my name without permission, all while insulting me. I was well within my rights to request the sale get taken down.
    • His host did not want any part in his shenanigans and when Jar failed to action the request, they pulled his plug briefly
    • Jar was upset about this and then tried to identify me IRL in order to intimidate me, including contacting the General Counsel of where he thought I worked. I fully believe this was an attempt to pressure them to fire me as retaliation for my criticism and refusal to bow to his bad behavior.

As I see here, you attack Jarland Donnel personally (you already know his name and surname) via his company.

Why you did not pursue legal actions but started this shit show? What's the point? Do you still want that MXroute (and all customers) face downtime / damage?

Your actions was not rational from the start. You are evil person. Jarland is not the angel, but he was triggered.

He already answered. Legal action is extremely expensive.

Unless something else happened that I'm not aware of, wasn't his goal to remove the insults against him, which was being hosted by his company? Whether or not Wyvern overreacted, his stated goal the entire time was to get the sale removed. I really wouldn't say Wyvern is, as you put it, evil, for trying to get the insult removed.

reading dramas is part of the job xD

On a serious note, if pulsedmedia wants to hire/interview me, I am more than happy and then they can message me and I can prepare for the interview but they haven't responded it so thus reading the drama.

Using public information to report @WyvernCo behavior to his so-called employer to complain about his antics, as long as that information is public, is not doxing.

This same was done to jar, reporting him to Hetzner

What a shit show, i like MXr as a transactional mail relay and nothing comes close, how jar usually reacts sure is uncomfortable and jar and MXr are both different legal identities you can file a case with a prosecutor or any murican police station if you are in murica and get done with it, also I would like angry storm san to just close this cess pool and let the peeps breath a little.

Reporting a ToS breach. That's quite different from tracking down and doxing someone and trying to get them fired.

No one is 100% innocent here, but I think people are going harder on Wyvern than necessary. He only tried to get an insult removed from jar's website.

Essentially, OP was not happy how Jar review other business's and how he deals with people who terminate accounts on bad review basis (try hosthatch on that matter ;) ). And he started the crusade which landed this topic as a finale.

"Expensive lawsuits" should be considered before you take any actions. If you can't stand for your actions in a court of law - then don't do it.

@Levi said: And he started the crusade which landed this topic as a finale.

That's skipping over jar escalating with his attack sale. Before that, did Wyvern do anything else other than criticize jar here, on LET? Do you believe that he should not have criticized jar and that jar, upon receiving criticism, was right to have used his superior reach to publicize an insult? That is when shit went down.

The sequence of events was not:

    1. Wyvern criticized jar and they got in an argument
    2. Wyvern tried to shut down jar's website

    It was:

    1. Wyvern criticized jar and they got in an argument
    2. Jar took it personally and created an attack sale
    3. Wyvern tried to report it to LET mods, who did nothing
    4. Wyvern reported jar's website for hosting the attack sale to to get the attack taken down
    5. Jar doxed Wyvern and tried to get him fired

    Who is harassing who here?

(IANAL) but Also one like wyvern can firstly make a post like this showing how jar attempted to (atleast) fire him and for really what and this backstory to us, but also to the court. I had previously suggested him to contact a lawyer friend just in case if there is a good lawsuit. So I am unable to see why he can't do both things

isn't the WHOLE drama about how jar tries to silence any criticism/bad-reviews online and your suggestion is for wyvern to do just that? It feels a little hypocritical if the other side isn't staying silent either and heck is doing botting within the reddit threads now?

@forest said: Before that, did Wyvern do anything else other than criticize jar here, on LET?

    We don't know.

I guess initial trigger here, on LET, was catalyst to the whole incident. But non-the-less, both parties is to blame and should solve their problems in a court. This drama for Wyvern guy bares 0 damage (except that his workplace now knows where he spends his majority of work time), but for MXroute this is collapse of public image. For Jarland personally - this may result in reduced income.

Do you think this whole ordeal is adequate in compare to Donnels actions?

  • forestforest Member
    edited April 8

@Levi said: For Jarland personally - this may result in reduced income.

    By your own logic:

@Levi said: "Expensive lawsuits" should be considered before you take any actions. If you can't stand for your actions in a court of law - then don't do it.

So shouldn't jar have thought about the PR consequences of his own actions?

    @Levi said: We don't know.

So why are you calling Wyvern evil if you don't even know if he did anything else?

As for court, that should always be the last resort and shows a complete breakdown in the ability to handle things socially. It's also very expensive. Even if Wyvern has legal standing for defamation, going through the court system is exceptionally stressful for all parties involved.

  • LeviLevi Member

@forest said: So shouldn't jar have thought about the PR consequences of his own actions?

He did it - he cancelled sales on LET and personally for me - I'am looking for new email provider (more expensive for the same features as mxroute).
