Are you talking in the context of the DSA ? We are a hosting provider but not an online platform.
The reason for Hetzner and hosting provider in general to do kyc is usually to prevent fraud.
Also we do require personal information for credit card payment as this is a requirement for payment processors, also to prevent fraud.
.
I hope you are right.
I feel that you did NOT answer my question
I think the law doesn't see it like that. I think they see you as a online platform you offer a platform on the internet (hosting)
Actually not, by law they are required to ask for your details. A bussines have to ask this from his clients this is a part of the KYC in the DSA.
Please check the definition of "online platform" in the context of the DSA. I wrote it to you earlier. It is: "Online platforms are defined in the DSA as providers of hosting services that publicly disseminate users’ information"
Only financial institution, VASP, MSBs (money services businesses), payment processors and other related businesses have KYC requirements outside of the DSA.
We actually do ask for billing information for credit card payment to prevent fraud.
I think we spent enough time circling around that subject, if you have information we are not aware of feel free to contact us and share it with us and we'll be happy to review it.
Yeah your choice of locations truly reflects that statement..
We're not a bulletproof provider and we abide by the law of the countries we operates in.
If your concern is the government of those countries snooping on your vps, you have several strategies you can use such as encrypting your vps disk.
We've updated our TOS. Feel free to let us know if you still see any grammatical mistakes.
I get this feeling that these TOS are not written by any professional attorney.
It is missing few critical things, in my limited wisdom.
— disclaimer: nothing in this post should be construed as legal advice. Just sharing my opinion
Thank you for your feedback, we'll send it to an attorney to review the changes.
Do you know what kind of attorney?
We appreciated your limited wisdom and non legal advice for the feedback regarding our ToS, if you have more feedback to provide we'll be happy to take it into account.
Otherwise we'd like to keep this post and comment section related to the service advertised in the post.
Thank you.
You’re most welcome.
I didn’t give any advice, just shared my opinion.
