Your are platform provider right ? Or is a hoster not a platform provider, so Hetzner is wrong because it's not a platform provider this is what you are saying right ?

Are you talking in the context of the DSA ? We are a hosting provider but not an online platform.

The reason for Hetzner and hosting provider in general to do kyc is usually to prevent fraud.

Also we do require personal information for credit card payment as this is a requirement for payment processors, also to prevent fraud.

Of course we consulted a lawyer when we incorporated.

digital goods do not require KYC.

    I hope you are right.

I think the law doesn't see it like that. I think they see you as a online platform you offer a platform on the internet (hosting)

The reason for Hetzner and hosting provider in general to do kyc is usually to prevent fraud.

Actually not, by law they are required to ask for your details. A bussines have to ask this from his clients this is a part of the KYC in the DSA.

Please check the definition of "online platform" in the context of the DSA. I wrote it to you earlier. It is: "Online platforms are defined in the DSA as providers of hosting services that publicly disseminate users’ information"

Only financial institution, VASP, MSBs (money services businesses), payment processors and other related businesses have KYC requirements outside of the DSA.

We actually do ask for billing information for credit card payment to prevent fraud.

I think we spent enough time circling around that subject, if you have information we are not aware of feel free to contact us and share it with us and we'll be happy to review it.

27.45 euros / year for unmetered VPS is expensive ?

    Yes considering the specs.

We cater to the privacy minded people and Monero enthusiasts, and are already one of the cheapest option for non KYC hosting provider.

But if this is not something you are interested in, you can certainly find cheaper options.

Yeah your choice of locations truly reflects that statement..

We're not a bulletproof provider and we abide by the law of the countries we operates in.

If your concern is the government of those countries snooping on your vps, you have several strategies you can use such as encrypting your vps disk.

Can I join ? Can OP explain to me what is the difference when I buy directly at Hetzner ? This is exactly the cloudline from Hetzner. I don't get this.

We add a no kyc, privacy layer on top of the cloud line of hetzner and we also accept crypto.

But is it not illegal if 1 company ask for kyc because of European law and then someone else is reselling that without kyc, don't you think this will get your service suspended eventually? I really don't see what is more private about is exept costing more money instead of going directly to Hetzner, it just doesn't make sense.

Additionally our unmetered servers are not from hetzner. And are our own virtualization stack.

Oke, that looks good ! Bit expensive but good.

Kyc is not mandatory for hosting providers. Only for financial institution as well as other related businesses.

By looking at the grammatical mistakes of your TOS section, I doubt those were written by a professional either

    Please see my comment above.
If you find any grammatical mistakes, we'll be happy to correct them if you report them to us.

There are many grammatical mistakes. Please contact your copy writer (may be called proof reader in your region)

We've updated our TOS. Feel free to let us know if you still see any grammatical mistakes.
