Why does Sharktech need to clarify anything more than they have with their statement on the matter? If anyone should offer more information it is @rectified.

I agree with @AnthonySmith's proposition.
No. I'm suggesting that when it was racked, it was racked under the SharkTech moniker, rather than as a client, which it should have been, even as the former-SA's wife.. to not do so would be an err on both parties' part, and anyone working remotely as a "Sr SA" to send hardware to be mounted without having direct access to the NOC to have their hardware dealt with directly does not beget someone who is actually capable of their job.
That's like buying a car and putting it in your employers' name. If they decide it's theirs- who is to prove otherwise without the proper paperwork in place?
The way I am seeing this is that Rectified was colo'd at SharkTech as part of a perk of working with them, and they were then fired and their hardware taken when SharkTech didn't get their way. Of course this is ALSO purely speculation, but having the hardware withheld with no statement as to reason beyond "seeking legal means" smells like someone is pissed and is doing their best to fuck their former-employee. The fact that they did an aggressive takeover attempt, and then took the hardware? I don't trust them. Either party.

It still makes no sense, we have some coloed hardware in 3 datacenters, they are all our hardware, it does not become DCs property no matter who runs the company (interestingly enough, Prometeus di Daniela Agro IS officially owned by Uncle's wife and a family business).
As I see it, the guy could have not racked himself the gear as he was never there, nor sneak some hardware in the racks unauthorized for the same reason, thus, the seizing of his assets unilaterally by the DC make even less sense from the legal point of view.
See? We agree on some things. The deeper I look into this, the less I buy the few statements made.

I wonder how long SharkTech knew how long this was going on.
Sharktech just finished updating their data centers and uplinks & hardware quite recently from their newsletter blasts, and as soon as they finished with that the head sysadmin is in deep shite for having a side business, seemingly strong armed into giving it up.
Was originally leaning towards they found a cabinet or a bunch of servers where they shouldn't have been, but even SharkTech mentioned "we thought it was his wife's reseller account" - Really?
He screwed up big time going near his own business and working on it during company hours, but the whole "we totally thought his wife was running the reseller account" seems a little flimsy at best. It's not even like he tried to hide the name, maybe she was just the CC holder.
I personally just don't believe SharkTech guys thought his wife alone was doing the web hosting, but more of a him working on the job issue. Interesting it came up right after the DC upgrades though.
Good job, LE investigators uncover more and more of this story.

2. there is no guarantee they will actually release the hardware, who knows if they don't claim further damages and continue to keep the hw hostage, after all, moving people off them takes time and money.

Ouch. Seems a lot of assumptions about intent and about details that none of us know. I can say for sure that I sympathize with the story told on both sides. There will be details we will not know, and should not know. Frankly, at this point, every public statement without a lawyer behind it is a liability.
The most logical conclusion from the data we've been given is that we cannot, currently and objectively, know who is most ethical between the two parties. This seems to be a battle that is not for us to fight.
Some great advice does come from this: always make sure your employers know what you do that could be called a conflict of interest. Make sure that you can prove that they knew and approved. Always give your employer the time they pay you for.
