i see a relevance. where is your imprint / impressum?
If it is a UK company, then he's legally obliged to provide the company name, registration number and address. That doesn't seem to appear anywhere. Not sure why you think it's a UK company though. Nothing on the website suggests that, the prices are in Euros, and he's said he's German,
According to his old Impressum:
Google Translate says that's "VAT identification number according to §27a of the VAT Act", the DE prefix would indeed suggest it's German at least in Feb, 2024.
He may of changed to UK, but he would still need to comply with VAT in any case, and I don't see a VAT number listed on his website -- granted, I took about 30 seconds with ctrl+f.
push @AS203446
He is going to hire 3 different lawyers Right now to check
Isn't he one of your biggest resellers?
I dont do Business with him. And i dont plan to.
@HOSTCAY once stated they had 44 servers with you. I guess the question is who is really behind their Seychelles LLC - do you even care?
Ask him?
I don't need to. I'm highlighting something for you.
You do a great job i Like it.
Do you mean that He doesnt have a imprint? @HOSTCAY can you Check if imprint?
I don't see any relevance to discuss this in this thread.
There’s some serious over the top support for Aurologic in this thread. It’s obvious the interface was changed, and honestly, the situation hasn’t been communicated clearly. None of us were actually there, so we shouldn’t pretend we can fully judge what went down.
That said, Aurologic’s behavior comes off as really unprofessional. Just mentioning anything about a customer without permission can already be a GDPR issue. But they went even further: they called him a kid and posted a link that basically reveals where he works with his picture on it making him easily identifiable. That’s textbook doxxing. He never gave them permission to share that, and he should definitely bring that up in court. I’m pretty sure a German judge would take that seriously.
It also feels like people are defending Aurologic just because they’re a bigger company. And seriously, what does an imprint have to do with a contract? If you think that’s relevant here, you’re really missing the point.
Okami
I understand.
Takeaway after reading 6 pages:
@jh_aurologic flaunting his typical arrogance, pretending he's the grown man while he's acting like 14 himself. This has been a trend that I observed on him for the last years, so not even surprised.
@AS203446 assumes that the cancellation window automatically moves from 90 days to less. I don't know why, but based on everything provided, it looks pretty clear to me: first term is 12 months, then extended month-by-month, 90 days grace period.
If you're saying the contract automatically extends by a year, then that's just outright scamming on Aurologic's side. Trying to get payment for a service that's not needed anymore by dickriding totally unclear contractual terms.
I've seen the way Aurologic does business before and this is not a surprise at all. In fact, this is basically their modus operandi. I'd never do business with them but I guess they're good enough for customers like Aeza (let me guess, they're paying good and in BTC?).
Anyways.
lol oh boy
Yep, might have been not the best way to comment much, anyhow - lessons learned, I'll keep myself out of the discussion and wont proceed in this discussion any further. Emotions dont have space here, there is no typical arrogance - most customers I do know personally, though :-)
We do have a bit more customers than the one mentioned, for details you may ask them on their own.
Bro, next time you feel like dropping a customer's place of employment, instead just take a walk through a TornadoDC corridor and get a sense of how accomplished you are at this point and how you don't need any of this.
@AS203446 I asked a real lawyer for you, if this gets dragged to court you'll be paying at least February and most of March since you canceled in late December as you said. There's no basis for the cancelation period being less than 90 days after a year. Renewal for a year seems like BS though considering it says "renewal term 1 month".
You guys should settle or it's going to be wasted money on both sides.
The 90 days cancellation notice period is invalid as confirmed by my lawyer and the court is not going to rule in aurologic's favour. My lawyer told me that it's not common to have a 1 month contract and a 90 day cancellation notice period.
Contract initial term was 12 months and this initial term ended on October 31st 2024.
Starting from November 1st 2024, the contract switched to month to month.
It doesn't make sense that the contract term is 1 month but the cancellation notice period is 90 days.
I tried to settle multiple times but aurologic refused to accept the one month. The last option is going to court I guess - I'm not going negotiate with aurologic after all those insults and comments about my employer and myself.
@jh_aurologic @AS203446
I’m going to propose something. @AS203446 pays for 2 months, not 1, but not 3. You’ll both save time and money this way. Yes or no?
Making sense or not, you agreed to it so you have to adhere to it?
Hilarious how both parties are in the wrong but very adamant about being in the right position. I guess that's how this went to court in the first place. Well, it's going to be a fun ride, keep us posted.
If anyone wants to make sidebets on how this gets decided, my money's on him being ordered to pay till 23rd March.
That's essentially what's going to happen anyway. So do that.
I agreed to this for the initial term. Not for the renewal after the initial term
I think drag each other to court and make some random lawyer money is better though.
You agreed to a contract that runs for a MINIMUM OF 12 MONTHS, extends MONTH-BY-MONTH and can be CANCELED ON 90 DAYS NOTICE.
The initial term being over has zero bearing on the remaining terms of the contract.
Your last post feels like ragebait tbh
So according to you I should have cancelled while still being in the INITIAL term to avoid another 90 days notice AFTER the INITIAL term.
And yes, I get it; But this wasn't communicated - the terms in the aurologic customer interface are not clear enough.
Even though there is a 90 day notice period, everyone can interpret this in various ways.
If you think your lawyers @AS203446 told you that you are right and that you have all the chances to win, then with all the debates and all the posts, take it to court and you will find out. You know that Aurologic does not want to agree with you?
Yes.
how does monthly renewal work then?
The lesson to learn is not to have confusing contract language.
"Renewal" term should be "payment" term. Full. Stop.
sigh
