I was assuming something similar, that is the reason I asked for a example filename, such as if they are running some type of abuse scan with a set of keywords has it flagged the files or are they manually going into people's files and having a poke around to find what is being stored, I doubt there has been a abuse report, if so they have a duty to provide that to the client.
I would assume if they are generally poking into peoples files with no evidence or reasonable grounds to suggest that the person is doing something leally wrong, not just a TOS violation that could be considered invasion of privacy as you have no reported an issue to request they may need to access your data to resolve an issue, even law enforcement need grounds and approval from the courts before they can snoop on you.

IMHO, violating customer privacy, taking his data hostage and trying to extort money to return the data is a much bigger offense, actually a crime. Forget TOS violation, the plot thickens.
Give time to provider to explain what they we're up to with customer data (it's weekend), but unless there's a satisfactory explanation, I also feel that provider tag should be suspended.
Or introduce "Provider who takes your data hostage" tag.
