Beware of this merchant. It has been known in NodeSeek that this merchant accesses your chickens in an unauthorized way. There have been reports from MJJ where this merchant accessed the chicken to find out why his chicken was using lot of traffic. The chicken was using traffic because it was being used as an airport. This is an unacceptable practice from merchants checking a users confidential data.

i think their TOS or AUP said they do not allow porn, no matter for personal use or business use, they have the right to suspend your account.
the $25 fee should be considered as some kind of ransome, as they didn't mention it on their TPS/AUP page
But, all the above sh!t are not important, the really important thing is, how they catch you? if there is no abuse email from others, how the hell they know you are hosting p0rn in the server?

You broke their TOS. So they can suspend at any moment. You have no valid justifications to pursue in this context.
Having said that, you do have a claim on related accounts. How charityhost knew your file if no abuse report.

theyve done this before where a user had high traffic - they logged into the customer's VPS and gathered evidence without notifying the customer
this host was called out and warned about this, they then updated their TOS to give them the power to do this and continued

i didnt read their TOS and i barely know what happend here.
But from my understanding the customer uploaded data that was not available to public, for his private usage / fun / what ever.
IF this is true, then he can hardly violate any TOS if the customer stored what ever data as private data without public access to this data.
All TOS always assume that the customer will provide what ever is forbidden to 3rd party and based on this they reserve the right to do what ever.
If i upload the porn movie clips of my girlfriend and me or my wife and my girlfriend or my dog having fun with a cat without giving anyone access to it, then normally it can never violate any TOS.
I do not know where the servers are located and i do not know where this provider's company is legally located ( and if its a company anyway ). But normally you as provider will actually violate contracts or law if you consume without permission content of your customers.
So i wonder, based on what a provider will check private content, that is not accessible by the public.
IF my assumptions / interpretations are right, then the customer has definitely right to complain. Actually i wonder if taking data as hostage and asking for money to release them could not actually considered crime. At least in germany, under this circumstances, it would be a crime to offer free hosting and then deny access and ask for money from the customer to save his data...

Thats a big no go from a hoster to check files from their customers.
I guess they do it if you really want to use your storage space so they can suspend your account cause its not profitable for them.
