@xvps said: It's fully legal to write the 14-day cooling-off period ends when the consumer starts using the service. For the same reason, you can't get a refund on domain names.

see FAQs - Guarantees and returns

The cooling-off period is officially called the “right of withdrawal”. It means by law you have 14 days to change your mind after you order something online, by telephone, or otherwise outside a shop. The cooling-off period expires 14 days after the day you received your goods or, for service contracts, 14 days after the day you concluded the contract. If the cooling-off period expires on a non-working day, your deadline is extended till the next working day.

Yes, there are certain exceptions (which will likely apply to domain names), but services are not completely excluded.

From what I have been told by a Danish lawyer, the following exceptions also cover hosting services.

online digital content, if you have already started downloading or streaming it and you agreed that you would lose your right of withdrawal by starting the performance

Some providers claim a VPS is a customized product, but that is a misinterpretation of the law and can't be used to write off the cooling-off period.

goods made to order or clearly personalised – such as a tailor-made suit

No, it's not. Not just because you feel so. You paid for service, got it delivered and then you changed your mind in the middle of the billing period solely because you got new service elsewhere.
For some reason, you feel like you have a right to dictate terms of service cancellation you purchased before the end of the billing period. You don't.
A refund would be solely at their own discretion as a sign of goodwill, not obligation. You're in the wrong.

Correct, a sign of goodwill, clearly they need the $23 more than me, for a VM they spun up in about 5 minutes, not an unreasonable request to ask for a refund when I just purchased the server hours ago. Like I said I wouldn't be opposed to some sort of restocking fee. They don't have an obligation to refund me, its called be a decent human being.

For the record, this wasn't done through the business, it was paid personally.

Guess what, yesterday a customer came into my shop, unrelated to the server, and requested a refund for her $500 purchase, I gave it to her, and charged her a 4% restocking fee to cover CC fees that I dont get back from Square. Did I call her entitled/ignorant, no, obviously not, Its called having business ethics.

@Stephnugs sure, but you're still wrong. You paid and the service was delivered, but for some strange reason, you feel like you should be "effective immediately" fully refunded (that's what you said in the initial post) just because you changed your mind.
Seriously, how's the host's fault here?
If anything is a dick move to post a "buyer beware" review just because you weren't able to force your way out of a contract you agreed with. So much about being a decent human being.

Fast forward to later in the day, I found out my business partner purchased a much faster dedicated server, for our business, with Hetzner. I then promptly opened up a ticket with Xeroz Tech to cancel our services, effective immediately, and for a full refund.

Yeah I paid personally because it was in Crypto, there is no record of the TX in my business checking account, only my personal checking account. But apparently you have a better understanding of my finances than I do

So that's just extortion thread after all to get back the money you paid for a service that was delivered. What a prick.

Its not extortion, its me sharing my experience with a particular provider. If you don't like it you can move along.

I am not moving anywhere. And this embarrassing thread where you introduced yourself as a shitty customer won't go anywhere either.

It's being a dick. Which violates the golden rule of LET. Seems lots of people are forgetting that one lately.

I personally think its a lot more "dickish" to hold my money ransom for a server I requested to be canceled hours after purchase, but everyone is entitled to their opinion.

Crypto is generally accepted as non-refundable on LET. Yet you're demanding a refund. While the terms you agreed say there are no refunds. And you're unhappy that they were willing to at least give credit instead, for future services. So you made a thread to try to drag their name through the mud, with the intention of using functionality that LET purposely does not have to cover your tracks once you've gotten what you want from them. Sounds like a dick move to me.
