DNS Resolver Quad9 Loses Global Pirate Site Blocking Case Against Sony

treesmokahtreesmokah Member
edited March 2023 in General

The injunction, issued by the District Court of Hamburg, required the Swiss DNS resolver to block its users from accessing the site to prevent the distribution of pirated copies of Evanescence’s album “The Bitter Truth“.

DMCA mafia wants you to die.
Switzerland - much privacy, freedom or something.

I'm unsure if the ppl behind this lawsuit know how does DNS resolving works - it will just fallback to other PoP to resolve this domain, literally nothing will change for enduser.

Wait, do other common DNS resolvers block these type of sites? (OpenDNS, CloudFlare, Google, Comodo). If not, what specifically is causing the DMCA enforcers to target Quad9 specifically?

I'm pretty sure said DNS providers are also in "queue" for a lawsuit.
And to answer your second question, I'm unsure why they went after Quad9 specifically - maybe because its maintained by a small non-profit and they won't be able to defend "as good" as for example Google in court.

Actually, you're probably spot on correct. Set the precedent with the little guy who can't defend themselves as well as the big dogs.

Some judges should probably not be allowed in court.

Or at least have someone with knowledge about it present. How can you rule on something without knowing anything about it. But the article also mentioned that the specific domain is already different so the block does nothing :)

quelle surprise. They are well known for their retarded rulings regarding copyright and the Internet. That's why all copyright trolls are going there with their lawsuits.

  • which side should quad9 block?

  • anyway, Evanescence is bullshit.

    always been.
terrorist attacks, glowies and much more - only in Germany.

    hail Merkel

    • you cannot say "hail" in germany, you will be sent to prison for that.
  • It's unclear why you think you're entitled to copyright music for free. Man o man, some of you people are the biggest assholes who go around yelling how much of an asshole they are. They think their "freedom" to steal is a thing but not for the content maker and their supporters.

  • is DMCA enjoying the work?

    You are retarded.

If you give anyone power to censor anything, it will always end up badly.
Today its music piracy - tomorrow it will be your favourite communist sites.
Its not like Germany is an absolute shithole for free speech already, and this win will only fuel their propaganda machine further - expect blocks on more "politically related" sites soon.

If you are still shameless enough to say that, take a sip of milk(not soy "milk") and do some research and then talk.

Not soon, already happend with indymedia linksunten. That was one of the darkest hours for the german legal system.
They couldn't find anything illegal so they made up that everything that is run by more than one person is a organization and the state can prohibit organization like they want. So now they can block every website they want, but that goes not far enough. Lawsuits are cumbersome because you need some reason. With the current lawsuit they would enable themselfs to block everything they want even without a lawsuit (so no answers to why something is blocked anymore) and every DNS resolver that is reachable from germany would have to comply with that and the copyright idiots are happy to be the trojan horse to push that through the legal system. If that system is established it will move from DNS to IP blocks and then to DPI, if you opened pandora's box ones there is no going back. So lets hope some court will stop this madness before it is to late or more like, stop it before it gets even worse.

I like the argument that spotify is amazing because westeners can listen to it for cheap but the price is even expensive for shithole countries where piracy is a good option because they don't have money to spare to listen to good music. (forgot where I got that argument from)

The only good thing about Spotify is music recommendations - despite them being based on a huge datamine they collect about you.
I wish there was some Player like nuclear with music recommendations that don't suck.

Spotify front-end in your terminal  but yes. Spotify's radio thingy is nice.

Yes, but no, its hard to vote against the really good wireless headphones they make and no one cares they went after Quad9, 99.99% of the Sony customer base doesn't know what Quad9 is or cares about some little site that people use for "illegal" stuff.

We, the people that care about this stuff - are literally 1% of their possible customerbase.
Most people don't give a shit - because they are clueless and barely operate the computer to post a new photo on Instagram, not to mention thinking for 5 seconds about what they are doing and reconsidering their "internet" choices. Then you have these retards on streets when shit hits the fan - despite them allowing it to happen in the first place.
Education is the key, but the world is filled with idiots and frankly always been. Nothing has changed, and never will.

The only hope is in NGO's like EFF to take matters to their own hands, but they need support of sane people, mostly monetary - for lawyers and campaigns.
