Your lawyer is telling you bullshit - EUCD is an EU law, which HAS to be implemented into local law or your country has to leave the EU, EUCD is also now 10y+ old and IS implemented in local law in all memberstates INCLUDING Romania.
Voxility was once similar to you, being big hosting warez sites and similar shit, then they got raided and basically buttfucked by your police (lots of HW confiscated, high fine, jail time for the owner (laid out as probation, but this ain't guaranteed) - The same will happen to you. The question is just when.
First please read our internet law but read it good not in hunrry . I dont live from hosting for the moment so i am not interested to atract problems if i dont win but what i can tell i am located in Romania wich internet laws is .............. poor quality ?
Yeah, trust me, I know the laws here and to which extent you can slip through the net, but what you do will land you in big trouble. Nobody here wants you to suffer, nobody feels threatened by your operation, also your customers wish you all the best, it is hard to get a cheap VPS in romania today.

Yah, I have a lot of laughs especially at indian/japanese ones, however, if the customer is infringing on some IP rights, this is an issue as we have a clause no illegal stuff which covers it, no matter if the "DMCA" is valid or not. So, it depends if you want shady or plain criminal people in your network, if you advertise "shady stuff allowed here", it will come, if you apply the ToS/AUP, they will know there is no room for maneuver and they will find other such naive people.

I know your laws very well and talked with lawyers in Bucharest for my ex workplace as we established a RO location.
Fact is, and if your lawyer tells you anything different he plain lies - i have the original physical mail from your government - that EUCD IS valid in Romania. If you ignore EUCD you WILL have to pay a fine NO LESS than 100k RON or face up to ~2 years jail. DMCA is invalid but as the DMCA contains informations about possibly illegal content, so you HAVE knowledge once you read it, you can get prosecuted for this as well.
Again, Voxility did what you do on a much larger scale and got raided (even more than once) - RDS will also not allow you to continue your game with them forever either, especially as it is now NOT Romanian owned anymore.
Your Moldova locations does also not matter unless you and your company move there - as RO company RO laws apply there as well, there is a clause for that (same clause used to prosecute RO citizen child abusers in i.e. Thailand and technically also for using drugs in a foreign country like NL).

around 22kEUR according to XE exchange rate - This is also in ADDITION to at LEAST probation and in worst case IN ADDITION TO JAIL. The fine does not remove the jail requirement, but as first time offender you'll likely get go with probation, but if you then don't stop you WILL go to jail (which is why Voxility and others now don't allow any warez anymore).
This is in your best interest - Sure, you can make some money with it now, but in the end it will bite you in the ass - I talk from experience.

The whole point in Romania et al isn't that there are no laws. The point is in the enforcement.
Certainly if one is in the gray area, he has more chances of getting hit than someone who is playing it safe. The difference is that the chances of something going wrong in places like Romania for natives is really really slim, unless you seriously piss other natives.
It's very hard to portrait how the Balkans work but it can be summed up more or less like this: If you are native and not a nobody, it's very hard something bad to happen to you. If you are native and a nobody, nobody will bother with you anyway. The obvious extreme cases aside of course (CP etc).

Yes, Austrian jail is excellent - Romanian is probably not good. Would not recommend.
This changed - Else Voxility and XServers would not have got problems, both are owned by Romanians.
@William when is the time for dmca jail can i opt for Austrian jail ?
