    It is not
    EU (and most other non EU countries) just have own laws that require the provider to act once they are aware of an issue.

    Getting a DMCA request, even while not legally binding in the EU, does make you aware of the issue which in turn, forces you to act.

    I am not aware of any DC or hosting provider who is, or was in jail because of DMCA.

    but I know dozen of them who ignore DMCA for 20+ years already, some even more.

    the one you talk about was raided because they were directly running IPTV operation and that was sole purpose of that "dc"

    Cloudflare, as a US company, is trying to doge liability since for ever now with the argument that they only a network operator and are not actually hosting the content.

    Try to report something that is actually hosted with them, like on their storage service, and they react within minutes ;)

    But like, all of this is not even worth the discussion.
    If it’s legal or illegal to provide DMCA ignored services in the EU is not really something up for discussion I hope.

    Sure there are a bunch of providers out there willing to take the risk. The risk is probably also not that high considering it usually needs a copyright holder who is willing to take the fight just for the sake of it.
    But I also never claimed otherwise.

    I just said it’s not legal.

    Although yes there is always that slight possibility that they (the states) do attempt to pull a Maduro on you for a Kiddo that sends a DMCA for shits and giggles and is upset that one does not give a shit about it. But otherwise, just no.

    Edit: Should mention. As far as i know, the owner of the domain is not real. My knowledge sadly stops at official places, so its unknown to me if either, Cloudflare refused to comply or the owner is just straight up fake, which i suspect.
