No, this is false advertising. There is nothing unmetered about this.
Tell that to Hetzner which also has a FUP except it's not shown anywhere in their documentation. I'd rather have the FUP clearly be shown than not at all.
Most providers advertise unmetered, but it usually comes with a FUP. The ones that don't either charge much more or are unsustainable to operate and eventually shut down (i.e., a certain provider that used to sell 10 Gbps truly unmetered servers for only $59.99 a month, and look what happened to them).
It says unmetered not FUP. So its still false advertising. Its not a case of, everyone does it so let me do it as well.

The 4000TB per customer FUP, does not mean there is no AUP. If customers do not comply with the AUP then we may need to suspend or restrict servers. This has nothing to do with our FUP. We have many customers doing more bandwidth than your account was doing. Unfortunately your account got restricted for breaching our AUP. This does not amount to false advertising.

Hi, I was wondering if I can subscribe to 10G Unlimited which really has no account level limitations?
Or maybe I can exceed the 4000T limit by purchasing multiple 25G (330T) machines?
In other words I would like to know if this type of FUP is only in effect for customers who purchase the 10G unlimited? What happens when the limit is reached? Is it a friendly discussion and an increase in the bill, or does it limit the rate of the port?
Thank you, both are options, both are actually just FUP.
If you pick the Unmetered option (10 Gbps port) and exceed 4000TB across your account, we may speak to you about changing plans, or adding additional TB to your account.
If you pick the 300TB per server option (with 25Gbps Port) and exceed 300TB on the server, we may speak to you about adding additional TB.
And to be clear - if you pick the 300TB (25Gbps Port) per server this does not contribute to the 4000TB per account limit for unmetered servers that is given to all customers.
However if you do not respond, or agree to increase then we reserve the right on each of the above to restrict your servers to 1Gbps. Of course we would hope you agree to purchase additional TB for your server, or account.
We don't charge any over-usage without you agreeing to upgrade your plan. So absolutely no bill shock.

10Gbps: Intel X520 or Broadcom 57414
25Gbps: Broadcom 57414
The 10Gbps servers depend on our stock levels of either NIC.

We do supply this on request. Pricing is £20, €25, $27.50 per month extra.
We can supply any hardware combinations but what we have on our website is more competitively priced.

it's unmetered as long as you stay within their metered cap, duh
