The only reason our provide tag was revoked was due to the Spamhaus drop list. We sent an email to Spamhaus explaining that it was a mistake and a misunderstanding. We provided all the necessary proof to show that we are not what they thought we were, and they removed us from the drop list. We then informed the LET admins about the situation, and we were able to get our tag back. There is nothing more or less to this.
Everyone has their own experience and POV. However, we are only using their ASN, and we don't have our own APNIC ASN atm.
You are using their ASN, but the dedicated server also seems to be rented from them only, and they are at WebWerks and CTRLS in Hyderabad. Both DC are good until DDOS you've got DDoS attack. My servers were down for 5 days because of a small DDOS attack, even after they had a null routing system.

Your TOS are using vague terms for FUP and no numbers are given for %cpu core utilization
For example, is it ok to average 30% for 24 hour window and not exceeding average 75% for any four hour window.
These are just arbitrary numbers chosen to illustrate my point. You may have different numbers.
Your example seems reasonable and within fair usage.
