Yes because it can ruin IP reputation/ cause spam complaints unless it is completely above board.
No-one with any right mind wouldn't allow you to do that as they don't want their IP's blacklisted.
It's for the good of everyone that people don't SPAM and therefore if you do, I advise you to stop because it's annoying to sort out, deal with and put up with.
If its legit go for Mandrill, if its not you'll be banned quickly.
I recommend you go with Mandrill if you do email marketing.
