Public vs Private VPN?

I'm not quite sure if I host VPN on a vps for a few customers then it'll be called public VPN (that some providers here not welcome) or is it just a private one?

Is it really a problem if my VPN does not allow bittorrent and spam mails?

    I don't think it is a problem but you'd better ask your provider...

    Well there is other content that is illegal - the type of stuff found in the onion sites of the Tor network.

    A public VPN is one that anyone (the public) can access. If you require a password, then the public can no longer access the VPN (thusly, private).
