Yes you will be convicted for the crime, not the ID. It is not illegal to own a fantasy passport (half the world considers my Kosovo one as non existing country) and if the other side just accepts it (and does especially NOT ask if it is real) you are golden, absolutely legal.
Banks apply different laws, as does gov/sec etc.
It's getting tiresome.
