"DISH Wins $42M Default Judgment Against “DMCA-Ignored” Host Virtual Systems"
... DMCA Takedown Notices Universally Ignored......
I see a pattern here.....
Best to go to Russia to him
They dont extradite
I remember the FUD about vsys going bankrupt last year when the suit was filed in Oct 2024. Seems like they didn't even choose an attorney based in the US to represent. Do they know something we don't? Are the Feds gonna show up in Ukraine?
Did we read the same article? They did the exact opposite, they ignored the US lawsuit. US courts have no power over Ukrainian entities, on Ukrainian soil.
So I read the article, one important part is:
The other is, this is US court ruling (confirming made up damages as filed by DISH) but how does it apply to company in Ukraine? So far Vsys didn't comply with anything.
Best I can do is $7/yr if they allow.
This is answer from their Live Support at website.
They do, the judgement just needs to be confirmed in Ukraine. It may take some more time, but eventually it will be done if DISH proceeds.
Are you saying that Ukraine will deny a favour for USA in time of war and active business relationships between countries? Are you live in Nicaragua?
Vsys has servers in the US and deals with US customers, US courts can absolutely take action against them.
would be good to hear from v-sys on this directly but imagien they will just do a ecatel and ignore or were all moving our stuff elsewhere ...
nm.
Smoke and mirrors.
Uh oh, time to move out of v-sys. Good time to come out of exile @Verasel
@vsys_host legal team
This is such a stupid basic mistake. If they have anything to do with USA, DMCA law applies then.
Otherwise USA courts would have zero effect there.
.... Until, the Ukrainian govt agrees. And time is such that, Ukraine would want to be an extension of US so it will readily comply if notice comes from US court.
I can also say you owe me 20 billion dollars. What does that mean, in the grand scheme of things? Can they order for the hardware to be seized? Maybe, but I don't imagine anything beyond that can, nor will, happen.
This is a civil lawsuit. The US government doesn't care.
What else would you expect them to say?
"Hey we're done for. Please everybody start panicking, cancel and move to our competitors!!!"
I mean you're right, but I fully expect to hear on CNN later today that Trump is pulling all support from Ukraine over this.
Nothing. The main issue in VSYS is they have servers in USA.
That was the main mistake: having servers in the United States and publicly announcing or stating on the website that it ignores the DMCAis the worst thing they could have done (Even if they only ignore DMCA in Ukraine, they can claim that they also do so on US servers. Even if VSYS they do not allow it..) A huge mistake.
Now what to do? Sell the US customers to another company that wants to acquire them or move to Ukraine.
The thing is, using a server in the United States and being present there, whether as server placement or otherwise, is a pretext and justification (albeit invalid) for the United States and lobbyists to come down hard on them.
Now, it is a matter of ignoring it. Register the company in another location and operate from there.
It only becomes illegal if they ignore a Ukrainian court order. Even so, be very careful with MLAT. How much do you want to bet that MLAT is being used to force this?
Note: Don't forget that the company is allegedly registered in the United States... that's another problem. (Virtual Systems LLC)
@vsys_host No, It is best to remain silent. Do not forget that:
1) VSYS was listed on the Notorious Market watch list
2) The company is registered in the US
3) They have servers in the US (even if DMCA is not allowed on the servers, they can use that as an excuse)
time to move, if you didnt yet.
The notorious market listing is essentially death sentence. It was with edis gmbh the same.
I'm wondering what Mr Smyrnov was thinking... If you're hosting doubtful content you don't
1) Register your company in the US
2) Provide US based services
yea fair enough, I forgot they had a US location/company which was not a smart move as everyting you said is correct
I don't think they have a US company.
(it's the Ukranian incorporation that was sued)
Are all of you seriously insane? VSYS IS NOT AN US COMPANY.
While vsys have no usa company, they have data center in Seatle. So this can be exploited. And one more re-itteration: Ukraine will comply to USA demands. And it will come as vsys is in the notorious list.
