I don't think any of the crap thats gone on is related to new agreements. A lot of this is just contracts they've had for quite a few years. Someone on page 1 said this one is at leat 3 years old?

Yeah contract began in 2021, last new lease was Jan 2023.
The claim is that they stopped all payments as of Sept 2024, so up until then DS had no real reason to cut their ability to source new equipment if requested.
I haven't read the whole docs, maybe they were behind from before then too.

Yeah didn't continue paying and still haven't so DS want hardware back but Path refuse to give it. Court in September which will determine if Path need to give it back during the lawsuit
I know Arizona is a kangaroo court of sorts when it comes to elections, but I can't see the court being like "OK, Path can keep all the gear, and DS has to sit, pound sand, and maybe get something some day".
Best I can see is Path makes a substantially large good faith deposit (> $500,000?) and asks to negotiate the terms, likely a lower rate, or ability to shed gear thats no longer selling. DS isn't in some big rush to get X9's back. Anything sub E5v4's is basically ewaste these days. You can barely give it away.
