Additional $20 pledge received over on OGF!

    $160 - ($40 + $16 + 20) = $84 to go. Who else is in?

    Thanks guys!

It would help if you had advice from a professional not LET.

@Not_Oles said: To have the corporation exist as the legally responsible party.

A corporation doesn't make decisions. It is not always responsible for all of your failures. So please don't assume you personally can dodge responsibility for something when it hits.

Filing still needs to be made, and correctly, you may encounter a cost for that, how will you prove you didn't make any income not enough to pay taxes? A bank account needs to be set up and proper accounting which is all more effort than it's worth for something like this. But it is necessary if the tax authority comes asking for your records. The penalties for failing to keep proper records can be significant.

It all adds up is what I am saying. Seen so many registering companies for their lowend business and quickly scrap the idea because of the above.

Incorporate it in the country you're living.

    In your case, US.

Yes, I am American! 🗽🇺🇸 But FreeVPS is not just me! FreeVPS has guys in Mexico, Canada, US, England, Japan, India, Sweden, and more! FreeVPS is at home in every country! 🌎🌍

Since there is no revenue involved then ideally you shouldn't care much about taxes & stuff? rather keeping things transparent with the Govt.
So do not create hurdles or more headache (as I assume it come with any free service being provided) for yourself. Register it as non-profit or whatever.
Like FreeVPS - there was a similar provider: https://yellowcircle.net/ registered in US. They were not generating any revenue either (as what I know - can be wrong). You can reach out to them and take suggestions maybe.

I visited the page you linked. Sadly, Yellow Circle seems to be defunct.

    Good luck!

Thanks for your kind wishes! <3

    Hi Lee!

@Lee said: It would help if you had advice from a professional not LET.

LowEnders are the reason why FreeVPS exists! FreeVPS wants to benefit our beautiful Low End!

We have really qualified and really experienced guys here. Such as you, for example.

@Not_Oles said: Is anybody an attorney or a solicitor who might help pro bono?

Definitely we agree on the importance of professional advice! Thanks for reminding everyone about an important question in the OP!

@Lee said: A bank account needs to be set up and proper accounting

Definitely again, we agree! Maybe somebody here could suggest an awesome Low End banker who could help FreeVPS get started with an account? Maybe also a wonderful Low End accountant willing to help pro bono? :)

    Thanks again, Lee!

    Best!

    Tom

  • An association would be the right step.

At least in many parts of the US, I hear that the initial registration is simple. I also hear, however, that federal and state tax exempt status is not always easy to obtain. I need to learn more about how technically qualified FreeVPS.org would be for federal and state tax exempt status.

How do you qualify for tax exempt status?

    https://www.irs.gov/charities-non-profits/charitable-organizations/exempt-purposes-internal-revenue-code-section-501c3

The exempt purposes set forth in section 501(c)(3) are charitable, religious, educational, scientific, literary, testing for public safety, fostering national or international amateur sports competition, and preventing cruelty to children or animals. The term charitable is used in its generally accepted legal sense and includes relief of the poor, the distressed, or the underprivileged; advancement of religion; advancement of education or science; erecting or maintaining public buildings, monuments, or works; lessening the burdens of government; lessening neighborhood tensions; eliminating prejudice and discrimination; defending human and civil rights secured by law; and combating community deterioration and juvenile delinquency.

If you do get it, there's annual filings to maintain it.

I think you're making a mountain out of a molehill. If someone wants a contact, give them your name and email. Get a PO Box and a voip # to keep your personal contact info private. No lawyers, no government forms, no IRS questions.

Absolutely right. If you believe there is a legal risk, the right thing to do is to stop FreeVPS project, not to complicate it.

I appreciate the work you have done in the past and this project is great.

    Hi @mrKik0!

FreeVPS is looking for a server in LA. Right now, the FreeVPS locations closest to LA are Phoenix and Coeur d'Alene.

You can see the current offers and locations on the FreeVPS website. Also, it's a good idea to keep an eye on the LET FreeVPS thread If you want to apply for a FreeVPS, it's important to/ read the requirements in the OP of the LET FreeVPS thfread.

Thanks for your interest in FreeVPS! I'm looking forward to seeing your request before too long! :)

    Best!

@Not_Oles just a suggestion to have some revenue you can probably use affiliate links of the sponsors on your website, this could help you fund your operations or atleast contribute in basic expenses like bank, CPA fees, state fees etc....
