It's not "legal" per their TOS but it's not like they'll ever find out unless you do something like email them and tell them.
I know a person in NL who use Dreamspark for his game server hosting company.
If you have purchased Visual Studio - outright with no special licensing terms then yes you can use it for your company. If you got it from Dreamspark, or Technet or some other source like that you cannot, this violates your agreement with Microsoft.

But what about Express Edtions, there is no problem with it right (in a company ) ?
Yeah visual studio express is fine for enterprise usage.
