Yes NL has native IPv6 and available on request :)

  • Looks good. Also good luck with bringing up your own AS. Will give you a lot more freedom.

    Thanked by 1Patrick
  • I'm curious about your Terms where you state all refunds are at your discretion. I'm not sure of laws regarding selling services in the EU, but wouldn't you have to comply with EU laws (if any) regarding this? I know EU residents have some pretty nifty rights concerning products bought over the internet, but services, i'm not sure about.

@coolnow i believe you are refering to these laws but they only apply to goods

There is a 7 day cooling off period for products, i'm unaware such exists for internet services.

Exactly. I believe it's for physical products only, not for services. I think web hosting is considered a service, but then again, I'm no lawyer.

Thanks and yeah it definitely will! Should be able to setup ACL rules for manual filtering for small attacks as well

Yeah, thanks for the clarification. I knew that the laws apply to goods but wasn't sure about services like these.

  • @mpkossen said:

It also applies to services. The only thing it doesn't apply to is 'custom' goods or services which is what some hosts use to not offer the 7 day money back period.

  • @ShardHost said:

Ah, OK. Thanks for letting me know! "Custom goods", nice one ;-)

All depends on where you are. Iniz are UK based. As I am UK based I am entitled to 14 days under the distance selling regulations, so they can't enforce 7 days on me (if I used them).

I doubt if the regulations apply to a product whose usage costs the supplier money. If you run through 10 TB of data in the period would you be entitled to all your money back?

    Its 7 days and nope.

In our terms it clearly states you are on a 30 day rolling contract unless you choose another billing term, the right to cancellation is denied upon service being delivered (upon payment usually). This is listed in the Distance Selling Regulation as well.

3.25 Once you have started work or begun to provide a service the

consumer is contractually bound to honour his part of the contract so
    long as you:

    ...

    • told them that their cancellation rights will end as soon as you do

    start carrying out the contract.

We offer 5 days out of generosity and even though it is vague, if a client has not abused service (spam, outbound ddos etc.) then we happily refund without questions.

Anyways I'd appreciate if you guys create a new topic and move of this thread, there's a vast majority of dedicated server providers and VPS providers whom you can talk regard there terms also.

Exceptions to the right to cancel

Unless the parties have agreed otherwise, the consumer will not have the right to cancel in respect of certain distance contracts. This applies to the following contracts:
    for the provision of services, if the performance of the contract has begun with the consumer's consent before the end of the cancellation period and the supplier has provided the written confirmation and additional information (including information that the cancellation rights will end as soon as performance of the contract begins);

    http://www.out-law.com/page-430#Exempt

TL;DR for the reading impaired: once the VPS is provisioned and delivered to the customer the right to cancel ends if the provider's TOS states "no refunds". Instant provisioning means you get 1 or 2 minutes not 7 days to change your mind.

TL:DR #2: the largest hosting company in Europe (OVH) has a norefund policy

Anyways I'd appreciate if you guys create a new topic and move of this thread

    :)
