Remember that you can not sell an OEM license. Only box products.
Unless your're from Germany. Here, selling OEM-licenses is allowed.

Yes, Microsoft lost a case against an OEM-reseller in 2009. The German Supreme Court (BGH) decided that you can not restrict the right to resale property in this specific case if the seller ensures that he does not retain a copy and gives you the CD/code.
Well, and if it's a downloaded license the resale should be allowed within the EU according to the ECJ.
Yes, a software license, OEM or whatever, can be resold in EEA ie. EU + Iceland, Lichtenstein, Norway (and soon signed Croatia)
