Manufactured lies from AUP violation taken way out of context. We enforce AUP when disallowed data is public but do not intrude on customers services. We do however support customers up and beyond when the customers requests support and permits support on their accounts.

He is settled. Even hosting with the free FTP now, but NOT on public.
We saw metrics of full FTP account. We do that and open tickets to customers at times to let them know about it if they should clean up or upgrade. At that point we checked what was public hosted and found the AUP violation data. Since you know about the content to an extent, you know what that is that we do not permit because of our long running ngo and faith based customers not seeing this as ethical. TBH we are forward more open and accepting of the AUP, however, it has to be privately stored. We do not think we are a brand suited to that kind of content (there are many other hosts happy to public host that and some even are dedicated to it), that's why it's in the AUP as disallowed. We did notify the customer and worked with him. We waived the $20 AUP violation fee since it's an admin fee to cover time and effort to mitigate and it it is there to dissuade AUP violations, but we can waive those when communication is done and it is respectfully understood. That being said, AUP violator never said he mistakenly violated AUP, so not sure why he thought it was ok to violate AUP, not once, two violations. Anyhow, the way ill informed members get carried away by a noisy AUP violator not communicating what happened and why correctly, and listening to half the story out of context makes a bad situation for everyone that does not understand the full story.

a) waived once communication is clear and understood on what occurred.
b) ignored and they go away without addressing the issue with us to it get it waived because they have no case and were intentionally at fault with no claim to be otherwise.
Actually we have not collected any Abuse fees yet. As said before, we do this to dissuade spammers, and potential customer that abuse. We waive services with abuse issues with no-fault from customers.

You keep insisting this was “public hosting,” but you advertised it as an FTP storage account (and he had it linked to a dummy domain). The customer had no reason to think anything in public_html would be publicly accessible, it was sold as storage, not web hosting.
On top of that, your own Terms of Service clearly say you’ll issue a 48-hour warning for AUP violations before suspending any account. You didn’t do that. Instead, you immediately suspended the account and then tried charging a fee just to access the files, your excuse for bypassing the 48-hour warning being due to the sheer volume of the material, however it was never publicly accessible so it should have never gotten terminated in the first place. That’s not in line with your stated policy.
Your explanations keep changing, too. First you said it was “random keyword screening” that flagged the files, then you said you checked because the account was at full disk usage. This isn’t the only incident either, other people have shared similar experiences about you accessing their accounts without permission and even changing root passwords. This doesn’t look like proper AUP enforcement. It looks like a case of not following your own rules, lying to your customers/the public, and infringing on user privacy. I don't know why you thought it was a good idea to post here after that shitshow.

The data was public. You can see it with a curl command using --resolve. (it's not public now, was moved to a private folder while the material is private on the free FTP account now, active, hosted but not public.
We do market FTP with LiteSpeed asset hosting capabilities, so yes, public_html is hosting on FTP accounts.
We have not changed any responses. The data was AUP violating publicly, the AUP violating customers knows and admits it.
We waived the fee in assumption he was not violating AUP intentionally (but he never said that either).
He is still an active customer with his free FTP account he won at a Wheel Of Fortune give away.
