By doing some additional research, I think the reason for their downtime was because the datacenter they were using found out about their fraud, hence why there was downtime and the site is now in a different DC.
i have no idea how this guys sustain this - even their paid things are almost offered, looking at someone that got a VPS with 6GB ram for 3$ / m it looks like another hostrail kinda of operation.

As I told a few times, real fraudsters will "push pedo traffic" in complete anonymity on other ppl's money, on open proxies, open wi-fi, hacked boxes, botnets, etc. They dont need any legal means to do so, changing the law (ToS, etc) wont change that fact as criminals dont care for the law.
They are just used by some hosts and by the state to not fulfill their promises, to censor the free speech and free initiative. AKA block ppl from posting "too good offers" at the discretion of X and Y, "creators" of the market, community, etc, deny service to ppl likely to use the advertised resources, "create filter and log" firewalls at ISP level to track down everything, so on and so forth.
