Some places say the DMCA ignoring. In some places it says that the DMCA applies. Do you have experiences? Does he ignore or not count?

  • No idea about DMCAs, but still - avoid. At least for their CH VPS offerings, they are either oversold or severely bandwidth-throttled. My KVM-based VPS had average speeds of 1-5 Mbits measured over a longer period of time (so it wasn't just a temporarily glitch). Their support said that this was normal as the link was shared.

  • Because it is shared, on the node (Gbit), on the ToR switch to nine (2x Gb) and at nine (Nx Gb upstream/peering).

    EDIS does not allow torrenting/P2P in their TOS, if this is what you're looking for.

    You cannot permit illegal activities in your ToS as EU company, this could even be seen as direct support and reversing liability.

    If DMCA is actually ignored or not depends on support agent and location, but as this customers are a minority anyway it is easier to just cancel them.

    Overall DMCA against EDIS is valid only in US and on ARIN IPs of EDIS Global LLC used abroad (none at this time) but Austrian law allows (and in some cases requires) 'due dilligence' so knowingly hosting warez can be criminal on the host side, the 'knowing' state coming in effect once reading the DMCA and verification of the website. P2P is fairly clear on the contrary as user fault and no way to effectively block it.

    This laws are similar in most West EU countries while the liability is nearly always 100% on the customer in East and Balkans (recently seen also in a case in Croatia local i have data of).

    These are always scenarios of 'likely win in court but the costs to go that long way are mostly not justified'. Freedom of speech on the other side is complicated only on nazi things and easy to stand up to also as smaller company as you can get legal/financial support by eg. CCC and similar, plus these are criminal charges (copyright is mostly civil) so the legal costs are clear as it is full on loss by default to the loosing party (which can be the gov).
