Stripe is probably the best/easiest you're going to get if you need a merchant account. Stripe is supported by almost every popular billing software, and if it's not there's probably 3rd party modules

As stated prior, legally, regardless of what your terms of service say, beyond it not being good business (it's obviously not) there are warranties of merchantability that have been breached.

Both the merchant and customer have the ability to cancel the sub, but ideally the customer agreed to it and therefore is the one responsible for it.
