I received a message from my host that told me that I had Unauthorized Use of Copyrights

They asked me to pay settlement of $250

I'm using these VPSes for providing VPN service so one of my clients may did it"He downloaded porn video" (I'm not sure if it is true or not )

What can they do if I do not pay(I'm not American)?What is my options?

Any one have similar problem?

    They can cut off your services. Just because you are not an american citizen does not make your leased american servers exempt from the law. You can attempt to collect the fees from your customer, but I doubt they are going to pay you. I would recommend you settle with them or they pay try and press the issue with your host who will in turn just shut you down.

    @agoldenberg I do not mean that because I not American I'm over the law

    I blocked the one that I thought he did it but of course no one going to pay any thing

    Can they do any thing more than cut off my services?

    Just ignore it and leave the so-called $250 is just an excuse to get more cash from you. these are automated emails too most of the time from copyright trolls.

  • This looks like an automated system. It is very unlikely they will follow through.

    I'd recommend moving to another host.

    Deny it, say your server was compromised, if they don't buy that request a statement and breakdown of material loss resulting from the download.

    And then if all else fails just change your details and run, I know this is strange advice from a host however this is just an automated system, the real honest answer is that no one cares who downloaded it, you are responsible because no one forced you to give access to anyone else but no one should be made to pay these stupid fines, I seriously doubt it is enforceable and any host would not cut you off on first offence.

    I think after your words that I'll began to move to another host to avoid more warnings in the future

    edit: I mean for that VPS only that I have problem with for not receiving such copyright complain in the future (as I read when searching on google)

  • It's exactly this why I think providing VPN services is such a risky business. I mean, unless you know exactly what you are doing. For example, a lot of the well known VPN services have their companies registered in some remote offshore countries... perhaps that's one reason why.

    You can't avoid warnings with moving to another host as that's not really host fault - they just forwarded you copyright complain. That's the standard way how competent hosts deal with issues like that instead suspending you and most of them in return want just your acknowledgement of issue and assurance that it won't happen again.

  • Well, no matter who your host is, you will receive warnings sooner or later.
    Just forward the warning to your client who was downloading whatever he was downloading, tell your host that this has been dealt with and that's it.

    That is a terrible idea, this is a completely standard way to do things, every host will do the same, what would be a better idea would be to lock down your VPN's so known public tracker IP's are dropped etc.

    Honestly the host probably could not care less, they just need a response within 24 hours usually so they can close the report.

    @rds100 I blocked that client because I'm sure that he is not going to pay anything but he may even do the same in the future

    there are so many cases like this, people who do not pay and ignore it will be put under more pressure with a letter sent home etc, just keep ignoring it and you'll be fine, they stop eventually (source: torrentfreak.com).

    but honestly, if you get already freaked out by this then im not sure if you should be providing these vpn services, this wont be the last time something like this will happen..

    But to be sure that I understand you well do you mean that I get this server down until the issue gone?

    I provide VPN service for over 500 clients for more than 18 months and it's the first time I received something like this that's all and because I do not have any knowledge with USA laws

    Only one notification like that with serving over 500 VPN clients for more than a year?! That's actually... impressive good. I would expect that you need to deal with things like that all the time.

    @Spirit Maybe I'm lucky ;)

    most of my clients use it for mobile so I do not use in total more than 1-1.5TB/month of bandwidth in all of my servers

  • I remember hearing about something similar to this awhile back, this one adult movie producer was sending out copyright letters to people saying they did this and most people would pay it because some people didn't want their wives finding out. If I remember correctly, they had no right to do so. I can't find the exact article, though.

  • CEG TEK is known perjurer. In fact, they tried to claim a client of @BlueVM was violating with a timestamp AFTER an iptables block was applied to the claimed IP:PORT combination.
